To prevent that from happening, an Emergency Voluntary Petition must be filed with the Bankruptcy Court. When that step is taken, an “automatic stay” is invoked under 11 U.S.C. § 362 that stops actions by creditors to collect debts and places the person or company filing for bankruptcy under court protection.
